These are our terms and conditions of use (“Terms and Conditions”) of this website (https://hkfla.hk/) (“Website”):

1. This Website is operated by Hong Kong Family Law Association (“HKFLA” or “we” or “us”).
2. You agree to comply with these Terms and Conditions by accessing or using the Website (including to download any materials from this Website).
3. If you are entering into these Terms and Conditions on behalf of any entity, you represent that you have legal authority to bind such entity.
4. By visiting and using this Website, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you continue to use this Website, we will take this as your acceptance of these Terms and Conditions. We recommend you print a copy of these Terms and Conditions for future reference.
5. Please note that additional terms, set out in our Privacy Policy and Cookie Policy also apply when you access or use this Website.
6. Registration and Membership
   1. You must register and be accepted as a member of HKFLA before you will be permitted access to member-only areas of the Website.  Find out more about becoming a member of HKFLA. If you are not a registered member of HKFLA, you will only be able to access content available to non-members.
   2. In order to become a member, advance payment of your membership fee when it falls due, is required. Payment for membership can be made through the Website, or in accordance with the instructions on the ‘Become a Member’ section of the Website.
   3. If you are renewing your membership, you must pay the renewal fee with the renewal information sent to you. If you do not make payment of the renewal free prior to the expiration of your current membership, your access to the membership services and Website will cease on the expiry of your membership.
   4. HKFLA may terminate your membership immediately at any time, by writing to you if you do not make payment to us when it is due.
   5. You agree to be responsible for maintaining the confidentiality of your passwords and all activities under your account.
   6. You agree that your account name and password to access the members only zone, are personal to you and should not be shared with anyone else. Furthermore, you will not permit anyone who is a non-registered user to access to any area of the Website which requires a username and password.
   7. You agree to notify the Secretary of the HKFLA immediately, if you become aware of any unauthorised use of your password or account identifiers by others.
   8. We reserve our right to cancel your access to the members areas of this Website immediately and without notice if we believe you have not complied with the Terms and Conditions. This right will be exercised at our sole discretion and your membership with HKFLA may also be terminated or cancelled forthwith.
7. Use of material appearing on the HKFLA Website
   1. This Website’ code, structure and contents are the copyright of HKFLA, save and unless specified, and all our rights are reserved. Any redistribution or reproduction of part or all of the contents in any form is prohibited other than the following:
      • You may print or download extracts for your personal and non-commercial use only, provided you maintain any author attribution, copyright or trademark notice or restriction.
      • You may copy the content to individual third parties for their personal use, but only if you acknowledge the Website as the source of the material
      • If you wish to use our content in any other way please contact the Secretary – admin.hkfla@gmail.com.
      • If you utilize any part of our Website in breach of these terms of use, you will be deemed to have accessed our Website without our permission and consent and we reserve our right to take such appropriate steps against you, without any notice to you. This includes but is not limited to you returning or destroying any copies of the materials you have made immediately upon demand and issuing a certificate of conformation to such extent.

8. HKFLA reserves its right to determine if refunds are to be provided if you are unable to attend any function or training or if the function or training is canceled.
9. We are not responsible for delays outside our control, for example but not limited to as bad weather or cancellation by a speaker.
10. The Website contains links to other websites which are not under the control of HKFLA. These links are provided for information or convenience only. Accordingly, HKFLA has no control over the nature, content and availability of those external sites. Furthermore, the inclusion of any links does not imply a recommendation, approval or endorsement of the views expressed within them.
11. Disclaimer of Liability
    1. Subject to paragraph 11.9, we disclaim all liability to the maximum extent permitted by law, and we assume no responsibility, for losses to you or any other person arising from:
       • third party content or user content;
       • our content, and in particular from the accuracy, completeness or current status of our content;
       • reliance on information contained or functionality provided on, or through, these Terms and Conditions or this Website;
       • inability to gain access to this Website or any part of it, or access is interrupted or partial, or functions with errors, at any time; and
       • any failure by us to perform, or delay in performing, any obligations, whether or not we give prior notice, if and to the extent that the failure or delay is caused by any circumstance beyond our reasonable control, and includes telecommunications failure, power supply failure, terrorism, fuel strikes, severe weather, computer breakdown, failure of suppliers to meet delivery requirements, industrial disputes and the absence of personnel due to illness or injury, and the time for performance of any obligation, the performance of which is so affected, will be extended accordingly.
    2. We will not be liable to you (whether in contract, tort (including negligence), breach of statutory duty or otherwise) arising out of or in connection with these Terms and Conditions for any loss of profits, loss of business opportunity, loss of goodwill, loss of anticipated savings or benefits, or for any type of indirect, special or consequential loss, even if that loss or damage was reasonably foreseeable or the relevant party was aware of the possibility of that loss or damage arising.
    3. Our liability arising directly or indirectly under these Terms and Conditions, or that is not otherwise expressly excluded under these Terms and Conditions, will be limited to and capped at the higher of HKD [8,000] or the fees and charges payable by you in the 12 months immediately prior to the matter giving rise to liability. The amount of this limitation of liability will be reduced by the amount of any unpaid amounts owed to us.
    4. Any claim by either party for breach of contract, tort (including negligence), breach of statutory duty or otherwise arising out of or in connection with these Terms and Conditions must be brought within one year of the act or omission alleged to have caused the loss or cost.
    5. Except to the extent that claims cannot be excluded or restricted by law, no claims arising out of or in connection with these Terms and Conditions may be brought by you personally against any of our employees, officers, consultants or other representatives involved in the performance of the relevant obligations.
    6. All representations or warranties, whether contractual or non-contractual, and all warranties, conditions, terms, undertakings and obligations implied by statute, common law, custom, trade usage, course of dealing or otherwise (including implied undertakings of satisfactory quality, conformity with description and reasonable fitness for purpose) are excluded to the maximum extent permitted by law.
    7. We do not guarantee that the Website will always be available or be uninterrupted. We may stop, suspend or withdraw or restrict the availability of all or any part of our Platform for business or operational reasons. We will try to give you reasonable notice of any suspension or withdrawal. You will not be entitled to any compensation or other payment upon the discontinuance, suspension, withdrawal or alteration of the Platform.
    8. The exclusions and limitations of liability in these Terms and Conditions do not affect our liability:
       • for death or personal injury arising from our negligence;
       • for fraud or reckless disregard of professional obligations;
       • for any other liabilities which cannot be excluded or limited in the jurisdiction to which any relevant claim is subject, including restrictions on our right to limit our liability in Hong Kong; and
       • in any other case, to limit our liability to less than such minimum amount as may be required in the circumstances under any other law or regulation relevant to the claim, in which case such minimum amount will be deemed substituted for the amount that would otherwise apply.
    9. These provisions are exhaustive of the remedies of monetary damages for each party or any third party against either party arising out of or in connection with these Terms and Conditions.

13. We do not guarantee that our Website will be secure or free from bugs or viruses nor are we responsible for any viruses. You are responsible for configuring your information technology, computer programmes and platforms to access our Website. You should use your own virus protection software.
14. Do not misuse our Website by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Website, the server on which our Website is stored or any server, computer or database connected to our Website. We reserve our right to take such appropriate steps against you, without any notice to you.
15. We may change these Terms and Conditions from time to time at our sole discretion and we reserve the right to so do without your consent. Any revised terms and conditions will be applicable at the time of publication on the HKFLA Website. Please review these terms and conditions regularly and each time you use the Website, you will be deemed to have accepted a variation if you continue to use the Website after it has been posted.
16. These terms and conditions, their subject matter and formation are governed by the laws of the Special Administrative Region of Hong Kong. All parties agree to submit to the exclusive jurisdiction of the court of the Special Administrative Region of Hong Kong.
